The current questions of the juvenile justice system with a special focus on the educational measures

This thesis is aimed at the current issues of juvenile justice system, especially the educational measures. The center of attention is the youths responsibility for their illegal acts, alternative process and measures, which are set up against the delinquents. Statistics show how the criminality of young people appears at present and what sanctions are taken against them. The main focus is aimed at the educational measures, which are specific to the type of sanctions imposed on young delinquents. The practical part shows the description of sample cases, where educational measures were imposed on young people. In conclusion is a recommendation and some incentives how to improve the current situation in juvenile justice system.

Foreign Fighters and the Challenges Associated with their Criminal Accountability JUDr. Anna Richterová The presented thesis focuses on the phenomenon of foreign fighters - a topic that has been for years appearing not only on cover pages of newspapers, but it is mainly a frequent subject of legal discussions and new legislations. The major reason is the connectivity of this phenomenon with the terrorism. The aim of this work is a comprehensive charting/analysing and elucidating of questions who the foreign fighters are, what their status is in the framework of the international law and what the possibilities of their criminal accountability are. In the general part, the work introduces and refines the concept of foreign fighters and foreign terrorist fighters. It offers both the historical and modern perspective of the participation of persons in armed conflicts abroad. It is followed by presenting the modern efforts to define the term of foreign fighters and explaining why the phenomenon of the foreign fighters and the measures against them are not new. The work also outlines the motivation of people to leave and fight in remote parts of the world. Child Soldier in International Law

Zuzana Kučerová: Child Soldier in International Law Abstract This thesis deals with child soldiers from the perspective of the international law. It is predominantly concerned with two questions: protection of children from recruiting and their possible criminal responsibility for international crimes. After a short introductory chapter, which covers a brief history of child soldiers, the second part gives an overview of international legal instruments which aim at preventing the underaged from being recruited into armed groups, as well as from taking part in hostilities. Those instruments belong to three different branches of international law: humanitarian law, human rights law and international criminal law. The author concludes that international criminal law in particular is the best instrument to protect children from becoming child soldiers. The reason is that international criminal law applies directly to individuals, including non-state actors such as commanders of paramilitary forces. It is also in force at the times when there is no armed conflict as defined by international humanitarian law. 1 Minimum age of criminal responsibility in English and Czech law - comparative study Abstract The subject of the rigorous thesis is criminal responsibility of juveniles, specifically the minimum age of criminal responsibility and its legal regulation in legal orders of selected countries - England and Wales on the one side and Czech republic on the other side. The minimum age of criminal responsibility in England and Wales which are both countries of the United Kingdom of Great Britain and Northern Ireland and typical representatives of Common Law legal system is 10 years old. The legal regulation in Czech republic as a representative of Continental Law legal system sets the age of criminal responsibility at the moment of completion of 15 years. The main aim of this thesis is to provide a reader with a comprehensive awareness of the legal regulation concerning the minimum age of criminal responsibility in surveyed countries and to compare these two different regulations via the method of comparative jurisprudence. First two chapters define the subject of this thesis from theoretical and methodological point of view. Translating and interpreting services for judiciary practice in Russia (compared to services provided in the Czech Republic)

The aim of this thesis is to describe the interpretation and translation services for judicial purposes in Russia and systematise the way in which they are used in judicial practice. The investigated topic is handled functionally and descriptivelyaccording to the following criteria: (1) development/historic - a description of the development of translation and interpretation services in the USSR and in modern Russia; (2) legislative - the status of the interpreter and the translator in the judicial process, their rights and responsibilities, formulation of ethical principles of their activities; (3) an objective evaluation - an assessment of the conditions for the exercise of a court interpreter and translator, qualifications and growth, the criteria for the selection of a professional translator/interpreter from agencies, the role of notaries in the translation process and its role in checking translations. Linking these aspects will enable not only a comprehensive view of the situation, but also to compare them with the services offered in the country.

Selected criminal law aspects of youth criminality Abstract The aim of this thesis is to point to selected aspects of criminal law, which distinguish prosecution and sanctioning of youth offenders from general provisions applicable to adult offenders. Youth offenders can be divided into two groups according to the Act No. 218/2003 Coll., on Liability of Juveniles for Illegal Acts and on Juvenile Justice. The first group consists of children, i.e. those offenders who do not reach fifteen years of age at the time of the offense. The second group consists of adolescents, i.e. those offenders who reach fifteen years of age but do not reach the age of eighteen at the time of the offense. These two groups of offenders are treated somewhat differently than adult offenders in the criminal proceedings, and the system of sanctions used to punish these offenders is also different from sanction schemes imposed on adults. In this thesis, the author outlines these differences and discusses selected aspects in more detail. The thesis also provides a historical excursion into the Czech criminal law that regulated the juvenile justice on the territory of the Czech Republic before the Act on Juvenile Justice came into force. The Criminal Responsibility of Legal Entities

The work deals with the criminal liability of legal entities in the Czech legislation. Part of the legislation are clearly explained. It includes the definition of a legal entity, criminal offenses and sancktions that may be imposed on a legal entity. Using the comparison is here compared Czech and Austrian legislation, their similarities and differences. Data obtained from the Supreme Public Prosecutor's Office and the Ministry of Justice show the use of this concept in practice.
Problematics of Child and Juvenile Delinquency

This work deals with the Problematics of Child and Juvenile Delinquency. The work describes the basic terms of children, juvenile and the factors which influence the crime. Among these factors, I included family, victimogenic locations and age . It further deals with concept of youth and its developmental tasks during adolescence. The conclusion describes the most common crime. The second part of this work verifies whether age is also an important criterion for the emergence and type of crime in high-risk locations. The criminalistic analysis deals with the criminality of the minors and juveniles in the territory of UO Ceske Budejovice.
